Temporary Staffing Data Collection
Background
The monthly temporary staffing data collection collects information in relation to temporary staffing activity across all trusts or providers in England. The data will enable NHS England to have oversight of NHS bank and agency expenditure within the NHS in England. The data will also help to support the efficient use of temporary staffing, in particular by monitoring performance against system agency expenditure limits.
Launch and submission dates
The data is collected monthly to collect the previous months’ data. Registered users will have access to the exact dates in the Data Collections Framework.

Legal basis
The legal basis for collection of the data is covered by the following:
Article 6.1(e) NHSE General Functions Section 1H of the National Health Service 2006 Act sets out NHSE’s general functions of arranging services for the purposes of the health service in England. NHSE relies on its general functions and its duties under Section 13E, 13N and 13YA of the 2006 Act to deliver systems that promote integration and the improvement of the quality of services.
Under Section 13E(1)(a) and (b), NHSE must exercise its functions with a view to securing continuous improvement in the quality of services in connection with the prevention, diagnosis or treatment of illness, or the protection or improvement of public health.
NHSE must also exercise its functions to integrate the provision of health services with the provision of health-related or social care services.
NHSE may deliver systems for the provision, improvement and integration of health services if it satisfies their statutory functions set out in the 2006 Act.
Section 13 D NHS England must exercise its functions effectively, efficiently and economically. Under Section 2(2) of the 2006 Act, NHSE may do anything which is calculated to facilitate, or is conducive or incidental to, the discharge of any of its functions. NHSE’s incidental powers are specified under Section 13Y of the 2006 Act where the power conferred on NHSE under Section 2(2) includes the power to enter into agreements
